Brandon and Jesse Widmark's preliminary hearing was scheduled for tomorrow. Hard to tell what is happening with the preliminary because the time estimate keeps changing, there have been numerous continuances and last I checked on the case, the court minutes had conflicting and different information in the morning and afternoon. The amount of errors are increasing due to short staffing, unworkable environments, not enough time and the chaos that Humboldt Superior Court has become under Judge Gregory Kreis.
I checked the case for the third time on 12/11. All three cases have preliminary hearings on three different days. Checking these cases multiple times with court minutes constantly being changed; if you are confused; tell it to Dumboldt Superior Court. At the end of the post, I listed each case and what was in e court the third time. Who knows if it will change again?
In the two cases for the same incident, it makes no sense to grant a continuance in one and deny it in the other. This is not the only case completely messed up. It is hard enough to check 15 or 20 cases a day, with multiple continuances a week and having to check cases again with changes within hours and days with several people needing to use the public computers. Court records used to be accepted as the official record. These errors are constant now. With the amount of preliminary hearings jammed everyday, why split two cases arising from the same incident and then createca reason for continuances?
Deputy District Attorney Luke Bernthal is the prosecutor. Ms. Andrea Sullivan is Jesse Widmark's attorney. Ms. Rebecca Linkous is Brandon Widmark's attorney. On December 6, Deputy DA Emily Norgaard appeared on the case for the People.
On 12/6,.Ms. Linkous requested a continuance due to her medical issue. Motion was denied in one case; granted in another. Ms. Sullivan objected to the continuance and asked for a motion to sever the cases. Ms. Sullivan is protecting her client's rights as she should. DA objected and court minutes say that motion to sever was denied by Judge Kaleb Cockrum. I wasn't there but I am sure Ms. Norgaard argued both brothers were involved in the same incident and crime spree across town so if a motion to sever is granted, it would complicate matters and be a waste of court resources and time twice.
Ms. Sullivan subpoenaed two records from the jail on 12/7. For all the reasons listed above, I am not sitting around on Monday for a preliminary hearing call that will most likely start late and for a preliminary hearing that may or may not happen. Hopefully, both brothers will plead and even if that plea happens tomorrow, I will update this post.
The original time estimate was three days, it was changed to one week, now it is two to four days. With the way the calendar are jammed and lack of courtrooms and court reporters, one attorney with a medical issue, who knows when this multiple day preliminary hearing will proceed ? And with three different preliminary hearings for three different days, I am not covering it in detail. I will post court minutes and the outcome for each case.
I covered this incident live, with many exclusives, including a live video. There is not much the People will present that is not known. The defense is the only new information. No one is reading a week's worth of coverage on this preliminary hearing. The community loses interest when these cases drag on for months. The ruling and outcome is what people are interested in and a better use of my readers' time which I respect.
