Cyndy Day Wilson anticipated litigation & letter leaves out some facts, context and she conveniently lets LOCO get a pass

 




This is an agenda item under closed session for the December 19 Board of Supervisors meeting. Ms. Day-Wilson's November 20 letter to the County attached with the agenda is posted in entirety below. 

I certainly have no issue with Ms. Day-Wilson's letter or any anticipated litigation but this entire letter should be weighed against court records and facts. Lost Coast Outpost did an initial article on former Deputy County Counsel's Cathie Childs lawsuit and then did nothing, as usual. Obviously that unredacted copy was provided to them and someone leaked the filing because there was no follow up or independent verification. Regurgitating, cut and paste from a court filing is sloppy and lazy.

Ms. Day-Wilson claims that she or Ms. Childs did not give the unredacted copy to LOCO. The only other way LOCO could get an unredacted copy would be from the County or filing with the court. So what exactly is Ms. Day-Wilson insinuating?

LOCO, NCJ and most local media don't go to court or once in a blue moon sit in a courtroom. They also can pay for court filings and write an "article" here and there and most of that coverage is only of interest to a small group of special interests or their lawyer friends or advertisers. Ms. Day-Wilson has advertised with certain other local media and routinely given information about filings to certain other media first instead of all media. Reader sleuths can look up what media she advertided with; some may remember where she ran ads. I did a lot of legwork on getting court records and minutes for this case for the public and because of Ms. Child's claims. When Ms. Day-Wilson was not Kalin's attorney and no longer representing Ms. Childs, I actually got to read good legal filings and deal with professionals.

I covered the developments in the Childs' lawsuit and another lawsuit Ms. Day-Wilson filed against the County. You can read the posts but the only successes in the Child lawsuit were when Mr. Dustin Owens specially appeared or wrote a motion. Judge Gregory Kreis took over the Childs case after Judge Timothy Canning denied the County TRO and injunction.

Another reason to wonder about the unexpected endorsement of Judge Kreis by First District Supervisor Rex Bohn in this election. I recall Rex at court campaign announcements last year but don't think he endorsed any Judge before this current election. Why is Rex getting so involved with the local courts? Both he and Kreis are running for re-election. The public should be aware of this sudden Courthouse bromance.When there are more filings, it will be interesting to see who else backs and funds Kreis and Rex.

The release of the grand jury report about former auditor-controller Karen Paz Dominguez was also by Judge Kreis, the only judge to do that in an election year. That worked out well for Rex and the County KPD naysayers didn't it? Which local "media" sources practically republished the County talking points against KPD and are flush with County ads? That is a rhetorical question.

I have linked all the previous posts I did on the Childs litigation. Ms. Day-Wilson and her husband filed another lawsuit against the County and for those of you who did not read those posts, you can look at them now and determine for yourself Ms. Day-Wilson's credibilty and claims against court records and minutes.

Setting aside Ms. Childs' claims, does Ms. Day Wilson have legitimate claims or is she just looking to make headlines?

Her time at the City of Eureka as an attorney was not impressive; she resigned. She was briefly former Deputy Public Defender Rory Kalin's attorney and her letter to the City of Eureka about Roy Gomez's claim never made it to court. Filing lawsuits is one thing. Follow through and winning is another.
