Half of EPD is waiting around the courthouse as usual for the courts to get their act together

(Boxell)

(Olivas)

Fourth of July suspects Dylan Olivas and Joseph Boxell's preliminary has been assigned to Courtroom 5. Olivas out of custody. The blonde in the video went viral is here. She just asked Times Standard reporter if he was John Chiv. Then she ran to sit with Olivas.

Deputy District Attorney Wayne Phillips, one of two new hires at the Humboldt County District Attorney's office is handling the preliminary. Deputy Public Defender Casey Russo is Olivas' attorney. Boxell's attorney is Deputy Conflict Counsel R.J. Leohner.

The alleged victim, Job Johnson, is here.

First, Mr. Phillips was late in Courtroom 2 and this was the second case called by Judge Kaleb Cockrum on the 9:15 preliminary calendar. He was not in any other courtroom and just sauntered down the hallway.

Then he spoke with defense attorneys; then with Johnson and we have been waiting half an hour for the courtroom to open. I heard rumblings about a continuance.

Half of Eureka Police Department is waiting around the courthouse and outside courtrooms as usual for the courts and the new Deputy DA to get their act together.

10:08 court opened. Judge John Feeney was ready. Olivas' cases are going to resolve. One year probation in the 4th of July 2022 case. Olivas pleaded guilty to an added count 3, PC 415 (1) as a misdemeanor. Count 2 was dismissed. In his 2019 case, Olivas pleaded guilty to Count 1. Count 2 was dismissed. He was placed on probation for one year.

Olivas 2022 court case:

Olivas 2021 case:

Mr. Phillips announced he was ready without checking one of the EPD officers was out of the county for training. So Boxell's preliminary was rescheduled for August 26.

Thanks to Mr. Phillips premature announcement, experienced EPD officers sat around all morning when they are needed by a department that is overstaffed no shortage of calls. Thanks to Mr.Phillips' lack of preparation and not doing the basics of checking if all officers were present, the alleged victim's time was wasted, Judge Feeney's time was wasted, the bailiff's time was wasted, a  court reporter's time was wasted.
