Defense filed a motion to continue in Sean Allman's jury trial. A defense expert bailing at the last minute is the main reason.
Allman is charged with Count 1 Terrorizing or Obstructing Exercise of Religion. Count 2 is Criminal Threats. Both counts pertain to the Episcopal Diocese of Northern California.
Deputy District Attorney Whitney Timm is the prosecutor for the case. Mr. Ben Okin is Allman's attorney.
Ms. Timm said, "People are opposed to the continuance in this case. The crimes are very serious."
"I thought when we were here in June, another attorney was going to substitute in," said Judge Kelly Neel. "Let's first address the expert. Four text messages and one video. What is your expert going to review?"
"I did meet with co-counsel," said Mr. Okin. "What we are working on is to address the people's expert. I believe she will opine my client intended this. I would estimate an expert and a report to Ms. Timm if we set this at the end of November."
"It is not something I want to pass to another attorney," said Mr. Okin. "I have done some hearings and prelims for 7 hours with physical limitations."
Mr. Okin said he was only asking for a 30 day continuance to get co-counsel prepared otherwise it would be ineffective assistance to counsel.
"Have the parties attempted a resolution?" Judge Neel asked.
"Yes," said Ms. Timm." As I recall Mr. Allman is not willing to enter a plea to a felony."
After hearing from both attorneys, Judge Neel granted the defense motion. "I think there is good cause. I don't like it but that is where we are. Each continuance has been a request by defense."
Previous dates were vacated. A special set for intervention is scheduled for Sept 22; trial confirmation is on November 3 and jury trial for November 28.
9/22: Intervention was continued to 9/26.
9/26: Pre trial conference scheduled for 10/20. Other dates still the same. No co counsel subsituted or listed in court system. I spoke with Mr. Okin and it will be Ms. Andrea Sullivan.
Defense has subpoenaed "over 150 mile and members Catherine Roghi, David Villauazo, Emma Harvey and Camilla Sigmunds."
10/20: Trial confirmation and jury trial dates remain as set.
