Humboldt Hill child abuse suspects Christopher Best and Gaylia Wilson's change of plea was continued to April 24. His deal is 18 years in prison. Her agreement is for three years of probation.
Best entered an Arbuckle waiver; Wilson did not. Both waived time for sentencing which is scheduled for June 23. Both cannot possess firearms or ammunition for life. Wilson was released on a Cruz waiver. She has to obey all laws and abide by the criminal protective order.
Best pleaded guilty to two counts of PC 288.5 (a). He will serve 12 years for Count 1 and six years consecutively for Count 2. The rest of the counts were dismissed with a Harvey reservation.
Part of Best's agreement is that he "give a full truthful interview to a DA investigator before sentencing," said his attorney, Ms. Andrea Sullivan. The People will not charge Best with anything he says even if the Court declines the plea. If Best withdraws his plea, then the information is admissible. Two Miranda stayements are excluded.
Wilson pleaded guilty to Count 3, PC 273 (a). The prison term for that is 6 years in prison but that is only if she violates probation. Wilson's attorney, Mr. Joe Judge said the agreement was for three years of probation and she could get "upto a year in jail."
Wilson has 158 days in custody. She gave up the lease to her house to her landlord, allowed the minor girls access to get their belongings and she will be living somewhere else.
Judge Timothy Canning told Wilson, " If you fail to appear for sentencing, your plea becomes an open plea. The Court can sentence you to the maximum."
Deputy District Attorney Carolyn Schaffer is the prosecutor for this case. She put on record that previously she incorrectly stated that Wilson did not report the first offender who lived in her house. Tjat was convicted molestor Everett Spillard. Wilson did report Best to the police.
Ms. Schaffer said that the minor victims did not want Wilson released before sentencing but she explained to them that legally that may not be a possibility.
