Attempted murder suspect Michael Cady finally in custody

 

On December 13, 2024, the Humboldt County Sheriff's Office asked the public's help in locating a third suspect  "Michael Cady, 34, of McKinleyville. Cady was involved in a robbery and attempted homicide that took place on April 13 in Fortuna." 

Cady was booked into the Humboldt County jail on his arrest warrant on May 6.  Cady was supposed to be arraigned yesterday but both Conflict Counsel and Public Defender's office had a conflict so Judge Kelly Neel continued the arraignment to this afternoon so the CAO could see if a private attorney was available. Ms. Rebecca Linkous accepted court appointment today represent Cady. Judge Neel entered not guilty pleas yesterday to preserve Cady's right to a speedy trial. Bail was set by Judge Neel at $750,000. Preliminary hearing is on 5/20.

Convicted felon Devon Demontigny was in court with her husband on 12/2. They certainly belong together. I should have known they were trouble from the moment they yakked and disturbed others outside the courtroom and continued that behavior in the courtroom. The bailiff in court that day looked exhausted and was not her usual self. The self absorbed Demontignys took full advantage to act out, oblivious to the fact that court was in session and disrespected everyone else. Devon was under the impression she was in an episode of The Real Wives of Humboldt County instead of a courtroom.

Peter Thompson held to answer for child abduction, HCSO Det. Vickman and Yurok Tribal Police Chief testified at preliminary hearing

Peter Thompson had his preliminary hearing on 10/23. Retired Judge John Feeney held Thompson to answer to PC 278 child abduction.

Before the preliminary hearing, in my coverage I had reported on two of Thompson's  family law cases. One of them was with Cindy Colegrove. Court minutes show she was present at the hearing with another family member. 

People's witnesses included HCSO Det. Danielle Vickman, HCSO Deputy Bradford Anderson and Yurok Tribal Police Chief Gregory O'Rourke.

Arraignment on information is on 11/6.

Convicted rapist Kailan Meserve continues to waste court time on what is fait accompli

Convicted rapist Kailan Meserve's defense causes another delay. I was the first one to report on his habeas corpus hearing and did several posts on that case. I was the only one who covered his rape trial and the one who broke that story about the rape case and covered it extensively.

The California Supreme Court denied to review Meserve's petition. He lost his appeal. He lost his rape trial.

"We learned that law enforcement obtained additional evidence that we have not yet received; we will make a charging decision after receiving and reviewing the additional information"

 

Christina Mills is on the must go list for April 13. As of 1:45 p.m. the District Attorney had not filed anything. Mills will be released from custody because she will not be arraigned today.

I followed up with District Attorney Maggie Fleming and Assistant Deputy DA Stacey Eads.

Mills court cases in the local court system are listed below and include a 2016 drug offense case and a 2015 property offense case.

Another case with no future date?

Criminal proceedings were suspended in Shantaram Jones' case. Jones was found not competent to stand trial.

On September 14, an order was renewed for involuntary treatment. No future date set.

CDCR inmate locator has no record for Marci Kitchen

As reported here first, Marci Kitchen was to be released on parole on August 11. The site is usually a few hours behind in updating.

Time estimate for Antone Aubrey's jury trial is 6 to 8 weeks

Further trial confirmation was scheduled for Antone Aubrey on June 30. Jury trial ischeduled for July 13 confirmed. Trial assignment is on July 10.

Michael Acosta says DA's office refused to provide discovery in his case and withheld discovery in the motion to disqualify him as David Anderson's attorney

Criminal proceedings were suspended before Wesley Starritt could be charged with murder and attempted murder

Criminal proceedings were suspended against Wesley Starritt on June 2 after Deputy Public Defender Jessica Bennett declared doubt. Starritt will be evaluated by Dr. Wilson. Starritt has already been through the PC 1368 process for a prior case and was deemed incompetent to stand trial. Then he was sent back from the State Hospital, certified competent and that case was resolved.

"The bicycle did have Bernie Sanders stickers on it. While everyone has the right to their political beliefs, in this case, it would go to motive and who smashed the windows."

Setting of preliminary date and motion of return for property was heard this morning in GOP vandalism suspect Michael Valls case.

Valls is charged with second degree burglary, vandalism of the local GOP office and two counts of resisting/obstructing a police officer. 

The BOS should consider themselves lucky Meagan O'Connell is willing to be the interim Public Defender

Public Defender Marek Reavis is on admin leave. After the David Marcus debacle, which took years to fix and the issues right now with court scheduling due to COVID 19, this Board should consider themselves lucky that Conflict Counsel Supervising Attorney Meagan O'Connell is willing to accept this position.

She is an excellent attorney. I see the way she manages her staff and offers them support daily. She is organized, she is professional and she is well versed with the law.

It only took the Jack Daniels jury a few hours to convict Jack Daniels

The jury started deliberating around 11:30, took a break for lunch. And this afternoon, after about three hours, there was a verdict. He has six other cases that were "trailing" this trial. Will he go for a plea and resolve those cases?

Drunk in public jury trial bumps homicide preliminary hearing

Preliminary hearing for Opera Alley murder suspect Connor Whited was scheduled on January 9.

As I previously reported, whether this preliminary would proceed depended on whether Whited's attorney would be available.

Woman who broke into an EPD officer's house sent to State Hospital

Humboldt County Mental Health medication  recommendation and CONREP for placement. for Jacquelyn Bradley was continued to December 5 since there was no report. It was continued again to December 23. CONREP report was received that day.

Based on CONREP recommendation, Judge Timothy Canning ordered that Bradley be committed to the State Hospital for an in patient treatment program. Bradley retained her right to refuse anti-psychotic meds.

Karen Ritter of Rio Dell arrested for a DUI, will she match her record for two arrests in 2018?

Karen Lynn Ritter was arrested by the Rio Dell Police yesterday for a DUI. According to one of my regular readers, Ritter did not react well "She went kicking and screaming. Totally off the rails."

Patrick Michael Marshall booked on Ramey warrant for rape

Patrick Michael Marshall was booked into jail yesterday after he turned himself in on a Ramey warrant for PC 261(a) (1), rape "where a person is incapable, because of a mental disorder or developmental or physical disability, of giving legal consent, and this is known or reasonably should be known to the person committing the act."
