"At this point we don't have Mr. Acosta present"


Convicted felon Robert Cullen had a hearing for his 2019 case and sentencing for his two 2017 VOP cases calendared this morning. Cullen's attorney Mr. Michael Acosta was not present when the case was called two minutes ago. Cullen's case will be recalled when and if his attorney is present.

This is the second time recently Mr. Acosta has failed to appear in court for a client that I know of; last time was for David Anderson and the hearing was rescheduled.

Mr. Acosta did appear via video conference in the afternoon. "Because of COVID and the emergency order of the Chief Justice, trial confirmation on April 20 and  jury trial for May 4 were vacated.

This is a time waived case. Trial confirmation was rescheduled for June 22; jury trial for July 6.

A bail review hearing is scheduled for April 13. Bail is $200,000 for Cullen's 2019 case. No bail for his two 2017 VOP cases. Sentencing for the 2017 cases will "trail."

Mr. Acosta told me previously he was planning to file a 995 motion on the assault charge. Due to the courthouse being closed, I haven't been able to check on filings. Nothing about that motion was mentioned today.

Deputy District Attorney Carolyn Schaffer was present for the People. Deputy DA Jane Mackie is the prosecutor for the case.
