On October 4, on behalf of HUMCPR and HUMCPR affiliates, Harland Law Firm's Ms. Allison Jackson filed and served Humboldt County a Verified Petition for Writ of Mandate and Injunctive Relief.
CEQA violations, environmental impact, public interest are alleged in HUMCPR's writ.
Here is the register of actions from October 2019. I will be covering significant rulings and the final outcome.
On February 27, there was a hearing in HumCPR's lawsuit against the County. Next court date is March 16. Judge Kelly Neel has to make certain rulings and the attorney of the County of Humboldt has not filed certain pleadings.
Ms. Allison Jackson was present for the plaintiff HumCPR. Ms. Sabrina Teller for the Respondent County of Humboldt.
Judge Kelly Neel: "I have read and considered the pleadings. Tentatively, the request for stay of proceedings is premature until the writ is filed."
Ms. Jackson: "This Court granted permissive relief on February 14. They (the respondent) cited no statutory authority regarding writ."
Ms. Jackson had to file pleadings without Teller's brief.
"For writ, they have to establish they have no remedy. They do have remedy. This is about avoiding the hearing on motions we are requesting. I have asked the Court to deny a stay."
Regarding Zone 2 amendments, Ms. Jackson said "This is affecting people. The people I represent are not people with deep pockets. They are regular people."
While the out of area attorney and law firm drag things out and cost taxpayers, the County, the Planning Department and the Board of Supervisors have yet to give me any response since October 2019.
As I pointed out in my previous post, the County does not have a good track record against Ms. Jackson. I have also done other posts on what lawsuits against the County have cost the taxpayers.
