David Kobak found guilty of second degree murder, special allegation is true


David Kobak was charged with Count 1, first degree murder of Fred Loftus.  Count 1 has a special allegation that Kobak "personally and intentionally discharged a firearm" causing great bodily injury or death to Loftus.

The jury was also given verdict forms for second degree murder and voluntary manslaughter.

The jury found Kobak guilty of second degree murder and the special allegation true. Sentencing is February 28. Sentence for second degree murder is 15 years to life. The special allegation sentence is 25 years to life. Judge Elvine-Kreis has discretion regarding the special allegation.

Deputy Public Defender Casey Russo put his hand on Kobak's back once the verdict was read.
