Ryder Stapp was sentenced this morning. He was cuffed and taken into custody to serve his 11 year state prison sentence.
As he was cuffed, it was the only time I saw a brief look of relief and a slight smile on Elizabeth Martin's face. She is Bob Beland's wife. Stapp's family members wiped tears.
Before Stapp was remanded, Judge Lawrence Killoran told him, "Mr. Stapp, the family and friends of Mr. Beland will forever be impacted by your actions that night. This is all very tragic. Hopefully, you will think about what has occurred."
On January 31, Stapp pleaded guilty to two counts on a second amended complaint. Stapp pleaded guilty to PC 190.5 (a) which is gross vehicular manslaughter. 10 years for that count which is the upper term. He also pleaded guilty to VC20001 (b) (2), hit and run with injuries. He gets 1 year, which is 1/3 of the mid term for that count.
The plea was for a stipulated term of 11 years in prison. Stapp was not eligible for probation because of the agreement.
Stapp got 4 days of total credits; two were actual days and two were 4019 credits. Upon release, he will be on parole for three years. Stapp has to pay restitution to Martin in an amount to be determined at a future hearing. Stapp has to a pay a $3,300 restitution fine and two court fines of $40 and $30. His bail bond was exonerated.
Deputy District Attorney Trent Timm is the prosecutor for this case. Mr. Neal Sanders is Stapp's attorney. Ms. Heidi Holmquist-Wells was present for the Beland-Martin family.
Before court, about 30 family members and friends of Bob Beland and Elizabeth Martin spoke privately with Mr. Timm. Many were wearing photos of Bob Beland and other photos. Two CHP officers were in court for the sentencing. District Attorney Investigator Braden Brawner was also in court.
There were about 10 people in court on behalf of Stapp.
