21 years in state prison for twice convicted sex offender Michael Franco


Alleged molestor and convicted sex offender Michael Franco had a "special set hearing," scheduled this morning. This was to see if the case would resolve before his jury trial scheduled to start did.

Counts 1 to 9 were dismissed. Franco pleaded guilty to an amended Count 10; PC 288.5 (a) continuous sexual abuse of a child.  The negotiated disposition is the aggravated term of 16 years for that count. Franco was a family friend and recurring access to the minor victim in this case.

He also admitted a special allegation PC 667.5 (a) that he has a prior conviction for lewd and lascivious act with a minor. This added 5 tears to his sentence.

The plea was for a total of 21 years in state prison. Franco waived his right to appeal excluding any IAC claims. Franco retains credits accrued.

While Deputy District Attorney Stacey Eads was stating the factual basis and going over detailed acts and locations described by Jane Doe and some of the evidence, Franco said, " that's bullshit."

This right after he spend several minutes going over the plea form in detail, signing it and pleading guilty.

Mr. Russ Clanton is Franco's attorney. Sentencing is on April 2.
