Manila 3 sentencing continued due to Judge Wilson's absence and no Arbuckle waivers

Three suspects from the Manila 5 were scheduled to be sentenced February 13. Victim, Tyson Claros' family and several friends were present. Family members were present for the defendants. The courtroom was packed with several people traveling out of state on both sides.

Emotions were running high on both sides. You could feel the tension while everyone waited outside the courtroom. The case has dragged on for years.

Judge Christopher Wilson is still out sick. The sentencing was moved to Courtroom 4 before Judge Kelly Neel. None of the defendant's had entered Arbuckle waivers. While Tamara Thomson was willing to do so, Hector Godoy-Standley was not. No pre sentencing report had been received for Mitchell. In an effort to keep all parties together and have victim impact statements heard at one time, the sentencing was continued to March 9. Judge Neel apologized to the family members for any undue hardship.

Tamara Thomson, represented by Mr. David  Nims, pleaded guilty to an amended count, PC 192 (a), voluntary manslaughter and special allegation that a firearm was used  in the commission of crime. Stipulated term of 14 years. She waived 1/2 her custody rights and right to appeal.

Brandon Mitchell, represented by Andrea Sullivan pleaded guilty to Count 2 carjacking for a 5 year prison term and special allegation that a firearm was used in the commission of a crime which carries a sentence of up to 25 years as well as added Count 3, voluntary manslaughter for a 2 year term, which he will serve consecutively. He did not waive credits but entered an apellate waiver.

Ms. Sullivan is on jury trial in another county.  Mr. Nims appeared on her behalf. Judge Neel had spoken with Ms. Sullivan this morning.

Hector Godoy-Standley, represented by Mr. Russ Clanton, withdrew his 995 motion and waived the evidentiary hearing scheduled for today.  He waived his appellate rights and all pre sentence credits. Godoy-Standley pleaded guilty to being an accessory to the crime of carjacking for a stipulated term of three years and 1 year term for the special allegation that he was "armed during the commission of the crime."
