Second juror in David Kobak says it came down to first or second degree murder based on the law and evidence


I spoke with a second juror from the David Kobak case who gave some more insight into their verdict.

Just like the first juror, this juror said they looked at the evidence, followed the law and Judge Elvine-Kreis' instructions.

After going through the law, looking at the evidence, especially the 911 tape, Kobak's interview with EPD Det. Ron Harpham and Fred Loftus' wounds, the jurors had some disagreement about first degree or second murder.

Based on the law and evidence, none of the jurors were for voluntary manslaughter.

Some jurors were for first degree and others second degree murder. Since they could not  reach an unanimous decision on first degree murder, they moved on to discuss the lesser charge of second degree murder. After deliberating further, they were able to reach a verdict on second degree murder.
