Despite his own concerns, victim's concerns, People's opposition, Judge Wilson sentenced Danny Waters to probation


Sentencing was scheduled this morning for Danny Waters. On January 10,Waters entered a guilty plea to criminal threats and admitted the special allegation of using a firearm in the commission of the crime.He was released from custody today

The other charges were dismissed. While it is an open plea and "the exposure is 13 years", Judge Christopher Wilson already told Wilson that he was willing to give Waters probation.

Judge Wilson said he would sentence Waters to 13 years and suspend that sentence and Waters would be eligible for probation. Judge Wilson said that if probation recommends no probation, Waters can take his plea back. Despite his own concerns, victim's fear for their life, opposition by the People and against Probation's reccomendation, Waters was placed on probation. Waters waived 260 days of credit to be placed on probation.

Waters' sister and brother are in fear for their lives. Waters threatened and told his brother he would kill him. Judge Wilson mentioned that Waters was 67 years old and that was a factor he considered when deciding a prson sentence but he also mentioned Waters' alcohol issues and fascination with firearms and that Waters had no remorse.

Waters' sister, brother and mother were not in court. Waters' friend John Salizonni was in court and he had a message for both attorneys from Waters 92 year old mother.

The prosecutor for the case is Deputy District Attorney Steven Steward. Deputy Public Defender Luke Brownfield is Water's attorney.
