Joshua Cooley's release could have been rescinded but another delay in timing at defense request

 


Sexually violent predator Joshua Cooley had another placement hearing this morning. 

At the last hearing, transient release in Humboldt as well as the possibility of rescinding release for Cooley had been mentioned by Judge John Feeney.

Since the last hearing, Judge John Feeney filed a motion for reconsideration of release. Dates had been set for filings on that and oral arguments in March and April. 

Conflict Counsel Supervising Attorney Meagan O'Connell filed a motion to leave the order for transitional release in place. And requested more time to respond to the Court's motion. 

Ms. O'Connell told Judge Feney that she is going to be out of the office for the dates proposed. She added there is investigation currently being done to litigate this issue and that COVID 19 has caused delays.

Deputy District Attorney Stacey Eads said,  "The People agree with the proposed schedule. I think we need to address this as soon as possible. I am in trial but the People will make it work."

Defense had subpoenaed records from Liberty HealthCare and the State Hospital. Ms. O'Connell agreed to only provide copies that she intended to use to Ms. Eads.

Defense request for setting of future dates in a month was granted . Next court date is April 9. Delay benefits the defense because if time runs out, due to the law, Cooley has to be released.

Representatives from Liberty HealthCare including Dr. Cameron Zeidler and Rafael Loya appeared via Zoom. Cooley's grandparents were present via Zoom today but did not say anything today.
