COVID 19 vaccination delays jury selection in Jeff Tsarnas case

 


The Jeff Tsarnas jury trial already started once and been continued at the request of the People and there was almost a repeat.

Tsarnas' attorney, Deputy Conflict Counsel April Van Dyke is ill and expected to return Monday. She was vaccinated for COVID 19 yesterday.

Deputy Conflict Counsel Owen Tipps appeared on behalf of her this morning and requested a dark day today. Jurors were already sent home.

Deputy District Attorney Roger Rees requested jurors be discharged and the jury trial be continued for weeks for a time it is certain Ms. Van Dyke can be there. That motion as well as the motion for witnesses to appear via Zoom was denied by Judge Timothy Canning. 

"Illness happens," said Judge Canning. He said court staff is going through extensive preparation to conduct two jury trials at one time. Continue this trial would be disruptive to scheduling and impact other trials.

Jurors will return at 8:30 on Monday. Jury selection will continue until 12:30. Judge Canning expects a jury to be picked by Tuesday. Opening statements and evidence are expected to start Wednesday. Time estimate for the case is two weeks. This jury trial is expected to conclude on March 26.
