"The difference between Mr. Tsarnas being convicted and the difference between him being exonerated."

 


Attorneys in the Jeff Tsarnas case were supposed to meet with Judge Timothy Canning at 1:30. Jurors were asked to return at 3 p.m.

Defense called Jamie Hansen. She was nervous, did not want to be there, said it had been three years. She said the visibility was low and there was "fig, extra thick." People did not have her testify. Deputy District Attorney Steven Steward did not cross examine her.

Defense rested their case. People had no rebuttal.

After jurors left, there was discussion off record.

Her son's statement was not allowed in; he said he saw a woman "lying down."

Judge Canning denied Deputy Conflict Counsel April Van Dyke's request "at bench" to recall CHP Sgt. Matt Harvey since Hansen could not independently recall her son's statement and even after looking at her statement, was reluctant. Judge Canning said that there were hearsay issues and it would be a waste of judicial resources. Ms. Van Dyke wanted this place on record, in case of an appeal.

Instead of just the briefing on the Brady violation, the People want to address the dismissal and Trombetta again and that motion will be heard on Monday, before closing arguments.

The Tsarnas jury will be deliberating in a different courtroom that only they will have access to.
