"A glaring set of errors that require a Marsden at the very least"

 


At the last court hearing for convicted molestor Mark Dare, Judge Kaleb Cockrum clarified how the hearing on March 29 before Judge Christopher Wilson would proceed.

"When you get in front of Judge Wilson, if Mr. Clanton feels there is an issue of IAC, a Marsden hearing proceeds." If IAC is found, "then there will be a further motion for a new trial," said Judge Cockrum.

Public Defender Marek Reavis is Dare's attorney. Mr. Russ Clanton had appointed for the limited purpose to look into a discovery claim made by Dare.

Deputy District Attorney Whitney Timm is the prosecutor.

Judge Wilson will preside over a Marsden hearing which is scheduled for April 2. This was after Mr. Clanton stated, "A glaring set of errors that require a Marsden at the very least."
