Defense files motion to dismiss in Jeff Tsarnas trial

 


The defense has filed a motion to dismiss in Jeff Tsarnas hit and run jury trial. The attorneys were ready to proceed with arguments but Judge Timothy Canning said, he would prefer to address it later today. 

On record, Deputy Conflict Counsel April Van Dyke stated "destruction of exculpatory evidence" and "illiciting testimony that is untrue."

While I understand Judge Canning's decision, the motion could have been heard in the time we waited 25 minutes for one juror. The trial didn't get started until 10:27 a.m.

The courtroom opened on time, the discussion about the motion to dismiss took two minutes. Jurors were brought in but one juror was not present so we waited around for 25 minutes for that juror. No reason why the juror was late. The trial was scheduled to start at 10 a.m.

Trina Comfort is testifying right now. It was brief. Comfort discussed her testimony with her two best friends. People had two USB drives with surveilance footage marked from the Bear River Casino. That was shown to the jury.  It was inconsequential. People rested their case at 11:21.

Jurors will be back at 2:30 for the defense case. Arguments on that motion are being heard now. Judge Canning will announce his ruling at 2:15.

A motion was denied yesterday. That could be overturned. Ms. Van Dyke presented information in her argument that directly addresses Craft lying, Trombetta and other case law.

Judge Canning already granted motion to dismiss the special allegation. Deputy District Attorney Roger Rees said,  "Ms. Van Dyke's motion is well taken."
