For now, Waterfront explosion suspect's jury trial confirmed

 


Waterfront explosion suspect Darin Vitolo had trial confirmation scheduled for March 17. Jury trial is on April 5. It was confirmed today.  Then he requested a Marsden hearing.

Vitolo has five cases, including the 2021 case, his most recent arrest. His previous cases include violation of probation.

In the meantime, Vitolo continues to be the ass he is and doesn't listen to his lawyer. Vitolo was pissed and he didn't like the fact that he didn't get his PCRS with credits for time served.  Vitolo thinks courts in the midst of a pandemic should accomodate whatever he wants and is in denial of his criminal history. So now, he us wasting more time with a Marsden hearing which is scheduled for Friday.

Deputy Public Defender David Celli is Vitolo's attorney. Deputy District Attorney Carolyn Schaffer appeared on the case for the People. 

Humboldt requested another emergency order last week and it was granted by California Chief Justice Tani Cantil-Sakauye. If the implementation order has been signed by Presiding Judge Joyce Hinrichs since yesterday, nothing was mentioned today nor has a press release been issued.

Judge Hinrichs said staff (which translates into court administration) is asking her to schedule dates at trial assignment. So on April 2, the same pattern that created the backlog will repeat.

Defense asking when the 60th day is scheduled is a sign.
