Defense called local attorney, Mr. Patrik Griego, to the stand this afternoon in the Jeff Tsarnas hit and run jury trial.
Mr. Griego clarified during his testimony that he is no longer the alleged victim, Marie Kelly's attorney.
This was the first time it was stated in court. It is another detail that the DA withheld from the defense. How much prejudice needs to be shown before Judge Canning decides it has hurt Tsarnas and grants a dismissal?
Even though he was no longer her attorney, Mr. Griego said assisted the DA's office and texted with one of the Deputy DA's about Kelly's civil case during the trial. He could not recall whether it waa Deputy District Attorney Roger Rees or Deputy DA Steven Steward. Mr. Griego said that he exchanged "two to three texts about the status of the civil case.
We found out the civil case Kelly filed against Jeff Tsarnas was settled by the insurance company and not with Tsarnas. He was driving Barbara Craft's car the night of the incident.
There was no jury trial for the case or court date because the case was settled.
Mr. Griego responded to Deputy Conflict Counsel April Van Dyke's saying "nothing was filed with the court" because the civil case was settled and so it was not neccessary to notify the court.Mr. Griego said "it would be our practice" but did not know if a conclusion letter was sent out to Kelly. This was in response to being asked if Kelly knew he was no longer her attorney.
Due to an uncoooperative witness, CHP not giving out CHP Sgt. Matt Harvey's cell phone and the DA and defense unable to reach him, the trial will resume tomorrow at 10 a.m.
