All these continuances on motions which could be moot if there is a plea



Ruling on the 995 motion to dismiss Counts 1, 6 and 7, motion to amend charge  and disposition/reset for kidnapping, robbery and assault suspect Franklin Molina was continued  to this morning. It was continued again to December 11.

With each hearing, we get insight into Judge Christopher's ruling but no decision. I  covered the last hearing in detail and today's hearings. By the time there is a ruling, I may just post the results of the motions.


All these continuances on motions which could be moot if there is a plea.

Deputy District Attorney Trent Timm is the prosecutor for this case. Deputy Public Defender Casey Russo is Molina's attorney.

The defense was going to file another 995 motion. Mr. Russo said he was going to object to the motion to amend and submit to the Court  but did not file anmended 995 motion but "my legal analysis" remains the same.

Judge Wilson said that while he understood the legal analysis may be similar but he wanted a response from the defense on the motion to amend charges.

"I'd like to see if these (new) counts are justified based on the preliminary examination," said Judge Wilson. "They were not charged at the time of the preliminary examination."
