DA asks for continuance in Chad Smith case; this was expected after last court hearing


Alleged molestor Chad Smith's third jury trial was scheduled to start on November 18. At trial confirmation, it was mentioned that his case would "trail" if the Patricio Segura jury trial proceeded. Deputy District Attorney Stacey Eads filed a motion to continue yesterday.

Ms. Andrea Sullivan was court appointed as Smith's attorney. She was not in court today. Judge Lawrence Killoran pointed out there maybe confusion about the dates since the motion was last minute. Ms. Eads also did not know if Ms. Sullivan was notified.

Trial assignment is November 15. Ms. Sullivan will be here tomorrow. The motion to continue will be heard tomorrow.

Smith piped up and asked Judge Killoran if there was an OR/bail motion filed. Judge Killoran told him to speak with Ms. Sullivan tomorrow and that there was no motion filed regarding bail.

Ms. Eads is the prosecutor for Segura and Smith cases. There are also three jury trials going on right now. Ray Christie in Courtroom 5, a jury trial in Courtroom 4 and Segura in Courtroom 2.
