What should have been a two hour preliminary hearing has turned into a two day preliminary hearing with a lot of information from both the People and the defense. Court resumes tomorrow.
At intervention for alleged rapist Joseph Hall on November 13, the preliminary hearing for November 18 was confirmed. It was continued to today due to courtroom availability. Late this morning, it was assigned to Judge Kaleb Cockrum and Courtroom 2 and didn't start until the afternoon.
The Public Defender's office filed a motion to set bail in compliance with equal protection and due process. Hall's attorney, Deputy Public Defender Wade Orbelian asked Judge Cockrum to rule on the motion after the preliminary hearing saying Article 1, Section 612 of the California Constitution had not been met. Bail is currently $75,000.
Hall is charged in Count 1 with rape by use of drugs and in Count 2 rape of an unconscious person. Both are serious felonies. If convicted, Hall will have to register as a sex offender and submit to HIV /AIDs testing.
EPD Senior Detective Harpham was designated as the lead investigator. He was one of the People's witnesses and testified after Jane Doe.
Deputy District Attorney Carolyn Schaffer is the prosecutor for the case.
Today in court, there was a Victim's witness representative, a staff person from North Coast Rape Crisis, two people with Jane Doe; one maybe her boyfriend.
Siren Song, The Shanty were two bars the defendant and Jane Doe went to before the alleged rape. Jane Doe is 23 years old and white and a student at the College of the Redwoods.
DNA evidence obtained from Jane Doe matched Hall. However, Mr. Orbelian's cross examination has raised inconsistencies in Jane Doe's statements as well as information that he could use to impeach her. She has made a prior allegation about a "date rape situation" and only decided to press charges after speaking to her boyfriend and finding out there was DNA evidence. Jane Doe texted Hall and said if he wasn't clean and had STDs, she would press charges.
Her demeanor in court was very different depending on who was questioning her. While that is true of alleged victims, the rolling of the eyes, making faces and the manner in which she was communicating with the man and woman accompanying while she was on the stand are all factors in judging her credibility. Complicating the "he said, she said" versions are observations by
the bartender's and they refute and impeach Jane Doe's testimony in court. The Shanty's bartender statement supports some testimony by both Hall and Jane Doe.
It will take time for me to post two days of testimony and information. This is not a black and white case. I would read all the testimony and information before making up your mind.
