"I have been trying to negotiate this case since it came to my desk."

At trial confirmation this morning for Gary Cudney, the defense and People had different opinions on how to proceed. Cudney is charged with the death of Dwight Davis aka "Dirty Dave."

The time estimate for the jury trial scheduled for January 6 is one month. Trial date was confirmed for now but a further trial confirmation was scheduled for December 17.

Deputy District Attorney Steven Steward is the prosecutor for this case. Mr. Manny Daskal is Cudney's attorney.

Mr. Daskal said he had not conferred with his experts about availability. "We are halfway between my offer and his offer."

Mr. Steward asked for a further trial confirmation so both parties could check with their experts.

"I have nothing to say," said Mr. Daskal. "I have been trying to negotiate this case since it came to my desk. People have issues with proof."
