Twists and turns: more charges for Franklin Molina or counts dismissed or resolution?


Ruling on the 995 motion to dismiss Counts 1, 6 and 7 and disposition/reset for kidnapping, robbery and assault suspect Franklin Molina was scheduled for October 16.

The DA filed a response opposing the 995 motion; the Public Defender filed their response to the opposition. Since the last hearing, the DA filed to amend the charges for jury trial.

Deputy District Attorney Trent Timm is the prosecutor for this case. Deputy Public Defender Casey Russo is Molina's attorney.

Mr. Timm said that the many of charges added include those recommended by Judge Kaleb Cockrum after the preliminary hearing.

Based on the new charges, Mr. Russo anticipates filing another 995. He stated a general objection on the record today ans said he had specific objections about the number of firearm enhancements.

"Mr. Russo and I are in communication to resolve the case," said Mr. Timm. "We were hoping for a tentative resolution. We are waiting for an offer from Mr. Molina and would need to discuss it with the victim."

Judge Christopher Wilson said both parties presented well reasoned arguments on the current 995 motion. Hearing on both motions was continued to November 6.
