Ba jury "hopelessly deadlocked" on sexual battery with restraint,told to further deliberate
Elhadji Ba is charged with felony sexual battery by restraint. The jury was also given a lesser options of misdemeanor sexual battery, simple battery and simple assault.
On Friday, jury went in at 3:40, a juror asked to me excused within 10 minutes. Alternate juror was called and deliberations resumed at 4:10. Jury left at 4:40 p.m.
Jury started deliberations around 9:45 and requested readback of the alleged victim's entire testimony. The court reporter left at 2:45. Except for lunch, they did not take a break. There was a note at 3:30. Courtroom was not opened for the note. However, it was 10 minutes later.
The jury foreperson told Judge Lawrence
Killoran that they are "hopelessly deadlocked." This after three ballots.
The jury foreperson mistakenly told the Judge that the court reporter left at 3:30. Since had only been a half an hour, Judge Killoran told the jurors to go back and deliberate.
The jury foreperson sighed and the rest of the jury was not thrilled either. Judge Killoran clarified that they need to find Ba not guilty of the greater charge before they deliberate other options.
They left at 4:40 p.m.
