Aaron Hungerford violated SWAP will probation and courts make him stick to the consequences?


Aaron Hungerford was arraigned for his recent DUI arrest on 10/29. Bail was set at 10,000. There is an OR/bail hearing today.

Hungerford was serving his jail sentence from a plea in August on SWAP. With the new charges, he violated SWAP and is now serving the rest of the sentence in jail until January 19. I reported this in my previous post.

According to the jail, even though bail can be set in the new case, because he violated SWAP he has to serve his jail sentence.

What will the Humboldt Superior Court Judge decide later?

Update:

Deputy District Attorney Jessica Acosta was in court for the People. Deputy Public Defender David Celli was appeared with Hungerford, on behalf of his office.

Probation assessment recommended Hungerford be released. Ms. Acosta said the People's concern was public safety and if the Court released Hungerford that an abstention clause be added to terms and conditions of his release.

Retired Judge Marilyn Miles released Hungerford on the two misdemeanor cases on today's calendar for entry into the Supervised Release program. The two cases were sent back to misdemeanor court and the next hearing is December 11.

Two terms and conditions were added;  Hungerford is not allowed to possess or use alcohol. He is not to drive unless licensed or insured.

After court, Mr. Celli said that Hungerford was ordered released on these two cases but it is up to the jail if they put him back on SWAP or he stays in custody.

Oct 31 update: Hungerford is on supervised release and no longer in jail.

Trial confirmation is on 11/12. Jury trial is on November 18.
