Opening statements started this morning in alleged molestor Miles Neiva'sjury trial. Prior to jury selection, Neiva rejected the People's offer to resolve the case. In December 2022, defense motion to dismiss Count 1 was denied.
I just confirmed that Miles Neiva is no longer employed with CALFire.
Neiva is charged with Count 1, PC 288.7 (b) oral copulation or sexual intercourse with a child 10 years or younger and Count 2 PC 288 (a) lewd and lascivious act with a minor under 14.
Neiva was arrested in September 2021 by the Fortuna Police Department. One alleged incident took place in Scotia in Jane Doe's mom's room and the other one in a garage in Fortuna.
Deputy District Attorney Whitney Timm is the prosecutor and Mr. Zach Curtis is Neiva's attorney.
Fortuna Detective Ryan Richardson was the People's first witness followed by Jane Doe.
Defense witnesses include Logan Neiva, the defendant's brother and a CALFire employee Michelle Cushcieri.
Before the final jury of 7 men,5 women and one woman and one man were finalized and sworn in, there were a couple of key rulings.

A prospective juror was admonished and excused for cause after Judge Gregory Elvine-Kreis questioned the potential juror.
