No testimony about sex toys but jurors will hear about hitting and choking in alleged molestation trial

 


This morning, is day 3 of the jury selection was still going on in alleged molestor Miles Neiva's case. On 12/7 defense motion to dismiss Count 1 was denied.

On Tuesday, Neiva was advised about the possible sentence he is facing by Judge  Gregory Elvine-Kreis. Neiva confirmed he is rejecting the People's offer to resolve the case.

Neiva is charged with Count 1, PC 288.7 (b) oral copulation or sexual intercourse with a child 10 years or younger and Count 2 PC 288 (a) lewd and lascivious act with a minor under 14. 

Neiva was arrested in September 2021 by the Fortuna Police Department. One alleged incident took place in Scotia in Jane Doe's mom's room and the other one in a garage in  Fortuna.

Deputy District Attorney Whitney Timm is the prosecutor and Mr. Zach Curtis is Neiva's attorney. 

After Judge Elvine-Kreis made a disclosure, one juror excused by stipulation.

All of the People's motions in limine were granted with ruling deferred on one motion. Most of defense motions were granted and one was denied.
