Less than a year after he pleaded guilty to rape of an intoxicated minor and was sentenced to prison, Timothy Miller Roberts was arrested again on a warrant by HCSO yesterday and booked on 9 counts alleging sexual acts with a minor.
I checked with the DA's office and this is a new case.
The arrest warrant charges include one count PC 288(b)(1) lewd act with a minor by force or fear , four counts PC 288 (a) lewd and lascivious acts with a minor under 14, one count PC 667.51(a) five year enhancement for conviction of certain sex crimes, one count PC664/288a (c) (2) attempted lewd act with a minor, one count PC 667 (a) (1) three strikes sentencing enhancement and one count PC 667.6 (a) five year sentencing enhancement for each prior conviction of a sex crime.
Before his plea last year, Miller-Roberts original charges in that case included similar crimes.
1/27: Miller-Roberts was arraigned on 1/27. He status is no bail. Public Defender's office appointed. Defense reserves issue of bail.
Preliminary hearing is on 2/8 and people will file protective order to be served on 2/8.
2/8: People filed and served protective order. Court signs discovery agreement regarding CAST. Miller-Roberts swears under oath he has no firearms. Preliminary continued to 3/9 by defense. People's motion to file amended complaint is also scheduled for that day.
3/9: Preliminary and motion to file amended complaint continued again to 3/14.
3/14: Held to answer. Judge Christopher Wilson did not make a finding for one special allegation"at this time." DA withdraws motion to file amended complaint. Arraignment on information on 3/28.
Charges for 2023 case:
3/28: Miller- Roberts was arraigned on information. Here are the revised charges.
Trial confirmation is on 6/29; jury trial 7/10.
6/29: Stipulation to continue.People to discuss offer and resolution with victim. Jury trial scheduled for 7/10 vacated. Trial setting on 7/27.
7/27: Trial setting continued to 7/31 by stipulation again so People can speak to victim about offer. Ms. Timm has been in jury trials including other sex abuse cases, back to back for months. Each sex abuse case has a designated prosecutor who follows the case from the beginning to conclusion and has developed trust with the survivor.
7/31: Trial confirmation is on 12/20/23; jury trial on 1/6/24.
