I have asked Ray Christie twice prior to the January 7 hearing if the People had made an offer to resolve his 2018 case. He said no. Christie also told me that he would not take a plea deal.
There has been no offer made since Larson Law Firm took over the case. I heard something about a resolution if Christie pleaded guilty to one felony count with probation but I have not been able to confirm if that offer was made and if it was made, it would have been during or before his first trial.
I contacted Christie yesterday. During our conversation, Judge Gregory Elvine-Kreis's ruling on the January 7 hearing and defense motion regarding the 2018 raid came up. Although Judge Elvine-Kreis denied the defense motion, I learned yesterday that there were two discussions after the lunch break and at the end of the day break. Judge Elvine-Kreis had asked to speak to Christie and the attorneys.
During those discussions, Judge Elvine-Kreis encouraged both parties to see if they could come to an agreement.
It is a little late to talk about resolution after tons of resources and court time have been wasted on retrying the case and on motions raising evidentiary issues.
Offering two chances to resolve the case during a hearing in the afternoon, after defense expert Charles Adams obliterated HCSO Deputy Travis Mendes' testimony and credibility on the stand and CDFW employees just blew off what was requested in the subpoena on the advice of their attorney "Stephanie" speaks volumes.
Judge Elvine-Kreis told Christie, "you barely survived the first trial with just one juror" voting not guilty. That isn't exactly accurate. I have included information from the first trial when I covered the verdict live.
Judge Elvine-Kreis told Deputy District Attorney Steven Steward that this is a simple case about four cows and there are a lot of complicated evidentiary issues.
If you have not read my post on the January 7 hearing and recent posts; you should.
Resolving this case would certainly end the spotlight and scrutiny on HCSO, state agents and agencies and stop the exposure of the selective prosecution and targeting that is Humboldt injustice.
After the first trial, the jury was hopelessly deadlocked on the four felony counts and 10 of the misdemeanor counts. Of the remaining 28 misdemeanor counts, there were three not guilty votes.
The jury foreperson told Judge Christopher Wilson that ballots in the deadlocked counts were 11-1, 10-2 and others were closer.
Christie had been charged with four felony counts of animal cruelty and 38 misdemeanor counts of littering within 150 feet of state waters.
