John Chiv: Motion to dismiss or suppress evidence denied, trial setting in May

The Ray Christie hearing did not take long to be over. It was eventually heard in Courtroom 3.

Christie's attorney, Mr. Rick Richmond appeared via Zoom which has been a first. Mr. Richmond's two associates from the Larson Law Firm, Ms. Caroline Glennie-Smith and Ms. Jodie Koo were also present via Zoom. By stipulation, subpoenaed documents from CDFW Ryan Bourque and Michael Van Hattem were released to defense.

I explained in my post earlier this morning why I would not cover the hearing in person.

According to Deputy District Attorney Steven Steward, Judge Gregory Elvine-Kreis denied the motion to suppress and denied the motion to dismiss. If you read my previous coverage, I already predicted this outcome.

Judge Elvine-Kreis found no bad faith as far as the evidence was concerned. This should have been expected from Judge Elvine-Kreis' remarks.

Judge Elvine-Kreis granted the defense motion to continue the trial based on Christies medical situation. I also said that would happen after the January 7 hearing.

Trial setting is on 5/9/22.

I expected the courtroom change to three this morning but as usual, Humboldt Superior Court thinks it is okay to post incorrect information on the online court calendar or make last minute changes in the morning due to the scheduling issues and a Judge MIA all week.

These kind of last minute changes happen all the time. It does not help that several experienced local court staff and supervisors are gone. They don't list trials once they start and all of this leads to people running around the second floor looking to see where to appear or clogging up the public computer or time clerks could use doing more productive work.
