Motion to dismiss, motion to continue in Sean Allman case

 


Sean Allman's jury trial scheduled for July 19 was confirmed at the last hearing. On July 1, there was a hearing on the defense motion to continue. People had no opposition to the motion to continue. It was granted for good cause by Judge Lawrence Killoran. Reason was not stated on record but hinted at in remarks by defense.

There is also a defense motion to dismiss. The People filed an opposition to the motion to dismiss.

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy DA Jessica Acosta appeared for Ms. Timm, who was in another courtroom.

Mr. Ben Okin is Allman's attorney. He said there is a new expert and based on the number of witnesses out of the area, requested a setting on the same day as the 995 motion to dismiss. Next court hearing is July 8.

At the last hearing  Mr. Okin said that he had been discussing "possibilities of resolution " with Ms. Timm "but we are nowhere close to fruition."

In his 2019 case, Allman is charged with Count 1 Terrorizing or Obstructing Exercise of Religion. Count 2 is Criminal Threats. Both counts pertain to the Episcopal Diocese of Northern California.

In December 2020, Allman was arrested by Fortuna Police Department on two DUI charges,VC23152(a) and VC 23152 (f) as well as one charge of BP4060, possession of medication without a prescription. All three charges are misdemeanors and he was released on O.R.

No charges were filed for that incident.
