One arrest, no charges and family DV case dismissed, but what really happened?



Kyle Kertscher, a paid staff member and Fire Captain for Fortuna Volunteer Fire Department was arrested on June 24, 2020 by the Fortuna Police Department.

Kertscher was booked on charges of inflicting corporal injury on a spouse (PC 273.5(a)), rape by force (PC 261(a)(2)) and false imprisonment (PC 236).

Kertscher posted bail. Bail at booking was $125,000.

Criminal charges were never filed. I checked a few times after his arrest. With the pandemic, there was no access to court records until recently. I checked the system today and he has three cases. The only case relevant to this arrest is a Family Law case. E-court minutes for civil and family cases are not accessible so I could only get limited information.

The family law case was filed two days after the arrest. 

Kertscher was represented in a family law case by Mr. Michael Robinson.  She was pro per. This was two days after the 2020 arrest.

The Judge was Gregory Elvine-Kreis. If you have been following my coverage on him; knowing more about his ruling would be relevant.
