Defense to file motion for new trial in Jason Barnes case



JASON BARNES sentencing was continued to July 27 and continued again to September 20. The defense made an oral motion to continue because a transcript is needed for the motion for new trial.

On May 5, a jury found Jason Barnes guilty of all charges, 3 counts and both special allegations. Sentencing was scheduled for June 14 and was continued to July 27 because defense plans to file a motion for new trial. The People objected to sentencing being continued.

Time estimate for sentencing is 1 hour.

Count 1 involuntary manslaughter; special allegation for Count 1 was use of a deadly and dangerous weapon.  Count 2 Assault with a deadly weapon; special allegation was great bodily injury. Count 3 was assault with a deadly weapon.

Counts 1 and 2 pertain to Bernhard Craig Bertain. Count 3 pertains to Shaelawn Mercedes JansenMorrow.

Deputy District Attorney Roger Rees is the prosecutor for this case. Deputy Public Defender David Celli is Barnes' attorney.

9/16: Defense made a motion to continue sentencing. September 20 date was vacated. Sentencing reset for 11/1.
