Ray Christie is only being retried on the 4 felonies

 


I reported on July 13 that local rancher Ray Christie's attorney had filed a motion for a new trial. The DA has filed an opposition. Trial confirmation for Christie being was already scheduled this morning. The defense motion was also scheduled for today.

Both were continued by Judge Lawrence Killoran to August 4 to be heard by Judge Christopher Wilson who was the presiding Judge for the last trial.

Ray Christie is only being retried on the 4 felonies. All four felonies are PC 597 (b).

 Despite being informed of this last week by Mr. Moutrie and apparently before last week , Christie's attorney said he wanted to know what charges Christie was being tried for. Mr. Cogorno wants something in writing stating that the DA will dismiss any remaining misdemeanor counts against Christie.

DA still has not received names of new witnesses defense may or may or may not call for the new trial. Improper jury instructions by the Court are alleged in the defense motion for new trial.

Deputy District Attorneys Steven Steward and David Moutrie are the prosecutors for the case. Mr. Moutrie appeared on the case today.

Mr. John Cogorno and Mr. Ken Bareilles are Christie's attorneys. Bareilles has not appeared on the case for a while.

As I also reported previously, the first trial resulted in a mixed bag of results.A hung jury on some counts, acquittal on some counts and conviction on some counts. Since Christie's first trial, the defense motion to dismiss was denied. Christie told me a writ filed was denied and that was confirmed by the information from the docket from the First District Apellate Court.

Ironically, HCSO Deputy Travis Mendes, one of the People's witnesses from the first trial was the courtroom bailiff today.
