Judge Feeney thinks Leiteritz case should resolve before trial

 


Judge John Feeney met for a lengthy period with attorneys in the Brian Leiteritz case. 

When the courtroom opened, Mr. Robinson beckoned Leiteritz and told him, "we will have a substantive talk after court today."

"Court and counsel had a discussion about resolution," said Judge Feeney. "We do not have a disposition; yet."

Judge Feeney asked "counsel to keep communications open. I think this case should resolve before trial."

There was no objection from the defense and the People's motion to continue the jury trial  was granted. The July 19 date was vacated. The witness issue is that HCSO Detective Scott Hicks is not available until "early August."

Trial confirmation was rescheduled for August 5; jury trial for September 13.

I have covered this case regularly after the preliminary hearing. The last two posts address DNA evidence, witness issue for the DA and a bench warrant issued against one of the People's key witnesses; Alicia Rose. There was no other media present at the courthouse or in court today.

Leiteritz is charged with Count 1 voluntary manslaughter and the special allegation of use of a deadly weapon in the commission of the crime and Count 2 Assault  with a deadly weapon and special allegation of causing great bodily injury/death.

Leiteritz's attorneys are Mr. Michael Robinson and Ms. Heidi Holmquist-Wells. Mr. Robinson was in court today and he is the primary attorney who has appeared for most hearings.

Deputy District Attorney Steven Steward is the prosecutor for the case. 

Leiteritz was in court today. There were two women with him for support. He had his mask on but looks completely different from his booking photo.  The injuries on his face have healed, he seems to have gotten a more traditional haircut and was wearing in a white shirt and black dress pants.
