DA files motion to continue in Leiteritz case due to a witness issue


Trial confirmation for voluntary manslaughter suspect Brian Leiteritz was continued to this morning. 

The District Attorney's office filed a motion to continue due to a witness issue. If you read the preliminary hearing coverage on this blog; that is not a shocker.

Settlement talks continue. Hearing on motion to continue  by DA was continued to trial assignment on July 16.

Jury trial for July 19 was confirmed at the last hearing with a hint that dates may change. Time estimate is 4 weeks.

Leiteritz is charged with Count 1 voluntary manslaughter and the special allegation of use of a deadly weapon in the commission of the crime and Count 2 Assault  with a deadly weapon and special allegation of causing great bodily injury/death.

Leiteritz's attorneys are Mr. Michael Robinson and Ms. Heidi Holmquist-Wells. Deputy District Attorney Steven Steward is the prosecutor for the case. 

At the last hearing, Mr. Robinson said "there has been a new development. Some DNA evidence that is outcome influential." Mr. Robinson also requested judicial intervention.

7/15: The DA filed a declaration in support to file an amended complaint.
