"I would like to caress your hot body" is just one of the texts Garcia Avalos sent to a 12 year old

 


There was an OR/bail hearing today for alleged child molestor Manuel Francisco Garcia Avalos.

Deputy District Attorney Whitney Timm is the prosecutor for the case. Deputy Public Defender Wade Orbelian is the prosecutor. DA Investigator Ryan Hill was in court.

Garcia Avalos' bail was already increased once from what is what at the booking to arraignment. Today, the DA asked for an increase in bail, 2.25 million for each life sentence he is facing. While that request to increase bail was denied without prejudice today; it can be revisited at a future evidentiary hearing or after the preliminary hearing. Judge Christopher Wilson did grant the DA's request for no bail. He faces three life sentences. There are three alleged victims.

Garcia Avalos admitted sending texts to the 12 year old alleged victim in an interview to law enforcement. Ms. Timm mentioned some of the text messages in court in her argument for increase in bail and no bail.

"I would like to caress your hot body" was one text. In another text, he mentions that "he touches her between her legs" and in yet another text that "he wants her hot body."

Ms. Timm, as always, was very eloquent about the fear and trauma experienced by these victims. Saying that no probation officer or term of release would be adequate supervision. Jane Doe #1 and Jane Doe #3 expressed fear if Garcia Avalos was released because he now knows that they came forward.

She said Garcia Avalos "manipulated these children for decades into keeping it secret" and "he manipulated family members and adults into trusting him with these children."

He was served with three protective orders; today in English but he will be given a copy in Spanish as well.  While an interpreter has been provided for every hearing, Garcia Avalos does understand English because he nodded his head several times when Judge Christopher Wilson was speaking.

Judge Wilson placed certain things on the record and in the minutes. He agreed with Ms. Timm on every point she made.

Garcia Avalos entered a 10 day time waiver today. The preliminary hearing for July 28 was vacated. It was rescheduled for September 7.
