Former Humboldt County Correctional Deputy and convicted molestor Cory Fisher had filed an appeal.
Since this post was published, on July 12, there was an update. Fisher's petition for rehearing was denied.
Christen Somerville from the California Attorney General's office argued the case for the People and and Solomon Wollack from the First District Apellate Project for Fisher.
"Defendant's convictions on counts 1, 4 and 5 are reversed. In all other regards the judgment is affirmed."
I have contacted Assistant Deputy District Attorney Stacey Eads about how this will affect Fisher's sentence.
It is a lengthy ruling and Ms. Eads will have to look over it but she sent me a prompt response based on my post.
"Based upon what you shared I do anticipate he will be resentenced," said Ms. Eads. "Further, I expect he will continue to serve a life sentence."
Ms. Eads prosecuted the case. Former Deputy Conflict Counsel David Lee represented Fisher. He retired. Judge Timothy Canning was the trial judge.
Fisher was sentence was 106 years to life.
