Setting of Andrew Cunningham's sentencing delayed to ensure all conditions of pleas are met
Setting of Andrew Cunningham's sentencing date and a receipt of Dr. Andrew Renouf's PC 288.1 report was scheduled for March 5. It was continued to April 4 for various reasons. The main issue being the return of certain items that were a condition of the plea. Judge Kaleb Cockrum wanted to make sure all conditions of the plea were met.
Dr. Andrew Renouf is going to be out of the country from March 26 to April 25. While he can evaluate Cunningham prior to leaving he will not be able to complete the report.
The probation report also has to be available statutorily for 5 days.
A PC 288.1 evaluation is a mental evaluation for anyone convicted in California of sex crimes involving a child.
On February 5, Cunningham pleaded guilty to a stipulated prison sentence of 20 years. Cunningham waived his right to appeal the sentence. Details of the plea are available in the previous post linked below.
The case is being prosecuted by Deputy District Attorney Carolyn Schaffer. Cunningham is represented by Mr. Michael Robinson.
