Murder charge dismissed against Lorna Leen


Judge Gregory Elvine-Kreis gave a detailed explaination why he found insufficient evidence to hold Lorna Leen to answer to the charge of murder.

He dismissed the complaint and ordered Leen be discharged.

Inconsistencies in Jane Doe's testimony, the three teens being under the influence of meth and marijuana, the crime being committed in the dark and other factors were stated by Judge Elvine-Kreis. "It is clear Ms. Leen attempted to intervene by attempting to get the phone."

Judge Elvine-Kreis said the People provided no case law supporting their theory why Leen should be held to murder or the aiding and abetting. Judge Elvine-Kreis said he had to research case law.

"Under the Phillips test, that does not seem to apply in this case, the act could be done to protect Ms. Doe or the son."

There is a lot happening this morning in court before the Cory Fisher jury trial starts shortly so I am updating this post as much as I can. now.
