John Doe #2 declined to press charges three times against Cory Fisher and did not reveal any sexual abuse to Officer McElroy


Former EPD Officer Ryan McElroy was the first People's witness today at Cory Fisher jury trial.
He gave a basic summary of the June 25, 2017  incident and the physical altercation between John Doe #2 and Cory Fisher. Officer McElroy testified that when he first responded to the incident on the 3200 block of Central Avenue, John Doe and Fisher refused to press charges.



"I cannot lawfully arrest someone for a battery, a misdemeanor, not conducted in my presence." Later at the hospital, when he learned of John Doe #2's injuries, the battery rose to the level of a felony.

During cross examination, Mr. David Lee questioned Officer McElroy.  He responded yes to the argument near Bear River Casino being between Angela Fisher and Cory Fisher. Officer McElroy did not take photos of Cory Fisher's injuries. Angela Fisher told Officer McElroy she did not witness the altercation between John Doe #2 and Cory Fisher.

Officer McElroy asked John Doe #2 if he wanted to press charges against Cory Fisher at the hospital, John Doe #2 said no. On July 8, Officer McElroy contacted John Doe #2 again, he refused to press charges against Cory Fisher. John Doe #2 did not mention any sexual abuse on July 8, 2017 to Officer McElroy

Mr. Lee asked and Officer Ryan McElroy responded yes, saying he could have pressed charges against Cory Fisher, even if there wasn't an alleged victim since the battery was a felony.
