Things starting to unravel a bit with the cross examination of Angela Fisher



Angela Fisher is still on the stand  and her cross examination will continue after lunch.

Things started to unravel before lunch as Deputy Conflict Counsel David Lee was able to get Angela Fisher to admit that she different statements to EPD officer Ryan McElroy and DA Investigator Kyla Baxley compared to what she said in court today. He showed  her written reports.

Angela Fisher testified in court that she saw the fight between John Doe #2 and Cory Fisher. Mr. Lee said that she told EPD Officer Ryan McElroy she didn't see anything.

Outlining specific dates when court paperwork was filed after the July 7, 2017 phone call when John Doe #1 told her about the sexual abuse allegations, Mr. Lee asked Angela Fisher why the allegations about John Doe #2 was not included, why she did not ask for a specific type of restraining order that would have caused Cory Fisher to lose his job, Angela Fisher said it had nothing to do with loss of income and that "all I wanted was a divorce."

When asked how John Doe #3 knew how to write in his declaration in legalese, she said she told him to write "I declare under penalty of jury" but not what to write. Asked the same about John Doe #2, she responded, "he is a smart kid."

Angela Fisher during direct examination and during cross examination was calm and honest until she was confronted with inconsistencies between what she said in court and in written reports, she was defensive. She gave responses to some questions; others she said, "I don't recall."

After lunch, Mr. Lee showed Angela Fisher some text messages exchanged between her and Cory Fisher. Mr. Lee asked her questions such as "U weren't concerned that the hatred the two boys had would cause them to make up the allegations?"

He asked her why she sent certain texts to Cory Fisher from July and August 2017, even after she had served divorce papers saying that she felt abandoned and asking Cory Fisher why he did not fight for her and the kids and because he did not fight for them, this meant the sexual abuse allegations were true. Angela Fisher said that Cory Fisher was "my life for 10 years" and that she did feel abandoned.

She also testified that law enforcement had advised her not to let Cory Fisher know they were investigating because he had arsenal of weapons and may try "suicide by cop."

Mr. Lee asked, "Were you playing a role?

Angela Fisher said, "Absolutely."

"I ask you again, did you have reason to doubt the allegations " said Mr. Lee. " You are telling him to stay and fight for your kids, telling him that if he wasn't guilty, he would want to fix things, that you did not doubt the allegations?"

Instead of just selective questioning by Deputy District AttorneyStacey Eads that supports the charges, just like the cross examination of John Doe #1, we learned more details and context during Angela Fisher's cross examination by Mr. Lee.

During the cross examination, Angela Fisher said that Cory Fisher punched a hole in the wall after John Doe #1 said, " you are not my dad."

"I knew the defendant had anger issues, he was pretty much angry all the time. He abused me physically when I was pregnant with John Doe #3," said Angela Fisher. She said that Cory Fisher "broke her nose" and that they did not talk about the incident.

Angela Fisher said "that the temper came on right after marriage. In the beginning  Cory Fisher did not drink a lot but that increased over the years."

Cory Fisher went to counseling a few times for depression.  Angela Fisher testified that Cory Fisher stole methadone from his own mother. Angela Fisher said that Cory Fisher told her he was impotent. This was when there was no sexual activity between them for the last three years of the marriage. Angela Fisher testified that she was present when when law enforcement questioned John Doe #1 about the Big Lagoon camping trip. She said John Doe #1 said he did not remember anything because Cory Fisher gave him alcohol. John Doe #1 was not given a SART exam.

Angela Fisher admitted that John Doe #1 told her that Cory Fisher was impetsonating him in text messages but that she saw and confronted Cory Fisher about sexting John Doe #2's girlfriend.

On redirect, Angela Fisher told Ms. Eads that it was Kris Wibbenhorst, a family friend, who reported the allegations to law enforcement. On direct, Angela Fisher had testified that Bobbi and Kris Wibbenhorst were the two friends she first went to when she learned about the sexual abuse allegations.

Angela Fisher said that she believed the allegations because her kids told her. In addition to shock, she felt betrayed.

Angela Fisher said she was "ashamed and embarassed about testifying " today "because I brought this man into my children's life."

Angela Fisher said there was monetary gain for her by the decision to report these allegations and her divorce. "I went from an income of $7,000 to 2,000 with the same amount of bills. I get no spousal or child support."

Court ended early this afternoon after Angel Fisher's testimony and will resume at 9:30 on Monday.
