Chad Holub and Officer James Jengeleski's testimony helps the defense more than the prosecution



It has been a little more than an hour into the afternoon session. The two witnesses to testify have helped the defense more than the prosecution.

Chad Holub, a neighbor and friend of Jon Goldberg's did verify a statement used in the prosecution's opening statement but the context and what else he said about the Goldbergs benefits the defense.

"He told me that I'm gonna kill that motherfucker and yeah that sums it up." That is the only statement the prosecution benefitted from this afternoon. Their attempt to portray Jon Goldberg as a violent, angry man via Holub's testimony failed.

Both on direct and cross examination, Holub said that he did not take Jon Goldberg's statement seriously because it was made in the context of Jon Goldberg revealing the unexpected news of his wife's affair with Tim Smith just hours ago. Holub said both on direct and cross examination that people, including him, say things when they are upset.

Twice Holub said, "I liked the Goldbergs a lot." He said he had never seen Jon Goldberg with a firearm when he was on the property. Holub said he never saw any signs of domestic violence between the Goldbergs. He did not hear gunshots the morning of September 26 but he did hear some voices around 10 a.m. Loud but Holub did not say arguing. Holub did not see who was arguing.

Describing Jon Goldberg, Holub said, "he was a  pretty mellow fellow."

Officer James Jengeleski has been the worst Fortuna Police witness. He wasnt even an officer until February 2016, just two months after he graduated the Academy. After being hired, he was under supervision of a field training officer until June 2016. Officer Jengeleski interviewed all the P G & E and construction crew employees in a group; which is not protocol. No statements were recorded. Notes of those interviews destroyed.

When asked crucial questions about securing evidence, Officer Jengleski responded with the consistent theme of his testimony, "I don't recall."
