"I was worried about never seeing my wife again, I was worried about never seeing my son again, I was thinking about the hurt I caused. I love Jessica. She is a wonderful woman. How did this all happen?"

In the afternoon session, Jon Goldberg testified about the moments before he drove up to the Smith house, Tim Smith walking out, what led to the shooting and finally him coming out with his arms up as SWAT came up his property.

Right before SWAT came up, he said he smelled his son's pillow and blanket, went to the back of his property and took a couple of puffs of bud and looked out at a peaceful spot.

Regarding Chad Holub's testimony about him saying, "I am going to kill that motherfucker.", Jon Goldberg said that
"from my memory, I said I was gonna kick that motherfucker." He said when he made that statement, he was upset. "After that I laughed a bit, I'd never beem in a fight. Tim was all muscle. A fit man. He would crush me."

In detail, Goldberg explained the emotions, the events leading up to him going over to talk to Jessica Springer. He explained why he had a firearm on him that day.

Goldberg was not expecting Tim Smith to be at 3150 Rohnerville Road. He had been fearful all day that Tim Smith's friends ir family would hurt him or Rachel Goldberg.

He testified that the day before after the fishing trip, and before they went for dinner, Tim Smith showed him some of his firearms.

When Tim Smith came out of his house unexpectedly, he did not acknowledge Jon Goldberg, he smirked at him. He did not apologize for his affair with Rachel Goldberg. Smith did not respond to Jon Goldberg saying, "I thought you were my friend."

 Goldberg said Smith looked at him. Seeing that Goldberg had a firearm strapped to his hip, Smith reached into his truck. While Goldberg could not see his hands, it looked like he was reaching for a rifle. Goldberg took his revolver out of the holster, he said Smith grabbed his arm. He tried to pull back and the revolver went off, accidentally. After that first shot, Goldberg said he closed his eyes and fired,does not know how many shots. He feared for his life. When he opened his eyes, he saw Smith on the ground.

Goldberg said all this happened very fast. "I thought he was going to pull it (a rifle) out and shoot me. I didn't have time to feel. It was all a reaction to the threat to my life."

As he was turning to walk away, he saw Jessica Springer. Goldberg said Jessica Springer said something like,"OMG, did you shoot him? Did you kill him?"

According to Goldberg's testimony, it was Steve Shapiro's idea to drop the van off at the Avenue of the Giants. Goldberg said the firearm was in the van and the van was locked.

Jon Goldberg called his mother from Shapiro's van. This was the second time on September 26.  He told his mother he shot someone. She asked, "was it Tim Smith?"
He told his mother he was going away for a long time.

Earlier that day, he called his mother that Rachel Goldberg had left with their son and he needed his mother to come home and hire an attorney to get custody of his son.

Jon Goldberg said moments before the SWAT team arrived, "I was worried about never seeing my wife again, I was worried about never seeing my son again, I was thinking about the hurt I caused. I love Jessica. She is a wonderful woman. How did this all happen?"

Towards the end of his direct examination,
Deputy Public Defender Casey Russo asked Goldberg about the narrative he gave Dr. Renouf about what happened. Goldberg said it was a basic outline. When Mr. Russo said that his testimony in court was more in depth, Goldberg answered yes.

Mr. Russo then asked Goldberg why he told Dr. Renouf that he hitch hiked home instead of getting a ride with Steve Shapiro. Goldberg said that he did not know what kind of trouble his friend would get into. "He has a family and a wife." Adding that it was he who just showed up at Shapiro's door.

There was some personal information revealed about Rachel Goldberg, "I love my wife to death, I trust her but she has been untruthful to me at times."

Asked by Mr. Russo about any variance in her personality, Goldberg said,"She'd be nice and sweet one minute. Totally change her demeanor the next. Sometimes she thought she had two people inside her."

Mr. Russo asked why he stayed with Rachel Goldberg.  Jon Goldberg responded, "I love her with all my heart."

Asked if he felt remorse for shooting Tim Smith, Goldberg said, "More than ever. I feel bad for Tim's family and all his friends. I wish that day never happened."

  1. Packing heat in a holster on your hip-you came prepared to fire the revolver! This doesn't get you off when saying "I feared for my life"!!!The scenario would have been calm WITHOUT a gun on your person, but escalated immediately when Smith saw the gun."closed your eyes" and kept shooting? WTF!!!! Everyone could have been shoot you flake!! You are all idiots and now a jury has to decide your fates-direct and indirect. Know what STUPID AND HORMONES MAKE? A DUMB DICK!!
