Kody Marcelli arraigned for his alleged assault case; victim Gary Harner was in court


Kody Marcelli was arraigned this afternoon. Mr. Greg Rael made a special appearance today with Marcelli.



Kody Marcelli's father, Mike Marcelli, accompanied him to court.

Mr. Rael requested 30 days to go over discovery and meet with Marcelli to see if he will be retained as attorney for this case.

Setting for the preliminary and confirmation of counsel is set for May 2.

A general time waiver was entered by Marcelli, who is out of custody. Mr. Rael entered pleas of not guilty and denial of the special allegation on behalf of Marcelli.

Deputy District Attorney Brent Kling was present in court this afternoon for the arraignment.

Count 1 is assault by means of force likely to produce great bodily injury. Special allegation for Count 1 is that Marcelli "personally inflicted great bodily injury" on Gary Harner.

Count 2 is driving when privilege is suspended or revoked for failing blood alcohol test.

In January 2018, Marcelli entered a plea in a DUI case from 2017. His attorney for that case was Mr. Greg Rael.

The alleged incident with Harner also occurred in 2017.
