Jon Goldberg found guilty of 2nd degree murder; not guilty Counts 2 and 3



Verdict in Jon Goldberg case: Second degree murder, special allegation true for first count. Counts 2 and 3 not guilty.

Before the verdict was read, Judge Graham Cribbs made some remarks. He knew there was a verdict but he did not know the outcome. The jury foreperson handed him the verdict forms in court.

Second degree murder carries a sentence of 15 to life. Special allegation 25 to life.

Sentencing is on April 27. Goldberg has not entered an Arbuckle waiver.

The counts as charged in the complaint:

Count 1 First degree Murder; special allegation of "personally and intentionally discharging a firearm" and great bodily injury to Tim Smith.

Count 2 is Assault with a firearm; special allegation that Goldberg "personally used a firearm", a revolver. Alleged victim Rachel Goldberg.

Count 3 is Exhibiting a firearm, a misdemeanor, "whether loaded or unloaded in a rude or threatening manner."
