DA rejects police report for Raymond Bacon's arrest by EPD in April

 

The Humboldt County District Attorney's ofgice rejected the police report and no charges have been filed for the April 2024 arrest of Yurok Tribe's Economic Development Corporation's executive director Raymond Bacon. There is still a tribal court case and a family law case and I explained in my last post about the criteria of any future potential coverage. Details about the April arrest are in previous coverage.

Broderick Brown arrested for burglary and stalking by Cal Poly Humboldt police

 

Broderick Uriah Brown arrested by Cal Poly Police for yesterday for PC 459/461(a) burglary and  PC 646.9 (a) stalking.

I reached out to both Cal Poly Humboldt Communication spokesperson Aileen Yoo and CPH Chief Peter Cress to see if this arrest is related to the protests or a separate incident. Neither have responded which isn't a surprise given a pattern over the years from CalPoly.

I reported in July 2023 on Brown's arrest by CalPoly HSU Police for PC 626.6 (a) direction to leave campus or facility due to interference with peaceful conduct; failure to leave or reentry.

Brown has a conviction in a 2016 DUI case. Two dismissals in 2021 and 2018 traffic cases after providing proof of correction. Out of 10 cases that come up in a search, Brown has 5 open cases including a case against Cal Poly Humboldt police filed 4/5/24.

Two arrests for assault, several harassment cases, did delay of mental health services by County and state cause a danger to public safety?

 

On April 26, Kristen Wise was arrested by the Eureka Police Department for attempted murder. The DA has charged her PC 245 (a) (1), assault by means likely to produce great bodily injury and a special allegation making this great bodily injury a serious and violent felony. Alleged victim Carylyn LoraLouise White.

This is at least the second case where I have noticed the DA's office has filed a complaint and first amended complaint on the day of arraignment which was 5/1 for Wise. She has a 2023 ase for assault & battery and several civil harassment cases in the Humboldt Superior Court system.

65,000 Bail was set at $65,000 by Judge Kaleb Cockrum and Conflict Counsel's office was appointed. OR bail is on 5/3; preliminary hearing on 5/8. 

A Kristen Wise of Eureka sued the County of Humboldt and California Department of Health Care Services for delays in providing mental health services. I reached out to the Legal Services of Northern California to see if this is the same person. I heard back that they would attempt to reach her but no other response after that communication.

I reported on this lawsuit in December 2023. Windy Acres filed a settlement on April 10. A dismissal hearing is scheduled for 12/6/24.

2021 DUI conviction, 2024 second DUI case with high BAC l

 

Andrea Hopkinson was arrested in January 2024 for DUI. It has been confirmed with the filing of the new charges that she is the one with the 2021 DUI conviction I wrote about in my previous post. I have been regularly checking on the case and the DA's office finally filed charges on 4/25/24. Arraignment is on 6/5.

Offer made in attempted murder, domestic violence and torture suspect's case

 

On 5/2,  preliminary hearing was scheduled for Jeon Durr.  It was continued by stipulation to 5/16 and offer made to resolve the case. 

The DA's office charged Durr with PC 236 false imprisonment, PC 243(d) battery causing great boldily injury, PC 664/187(a) attempted murder and PC 273.5(a) corporal injury to a spouse or cohabitant and added the toture charge later.

On May 4, 2024, at approximately 2:45 am, Humboldt Communications Center (CHP Dispatch) received a 9-1-1 call of a pedestrian lying down in the lanes of northbound US 101, near Piercy, CA.  The California Highway Patrol’s Garberville Area officers responded to the scene.  Upon their arrival, officers located a pedestrian who had been struck by a vehicle.  The pedestrian was pronounced deceased at the scene and the involved vehicle(s) did not stop or call 9-1-1 to report the incident.

Analia Martinez's motion to remand continued for the nth time, Kathleen Bryson to withdraw as counsel

 

How many hearings do we need to continue on the motion to remand this stalking and criminal threats suspect? She has been arrested multiple times, the DA filed a lengthy declaration, there is a protective order filed against Analia Martinez and the protected party is a local attorney? She was held to answer on charges after the preliminary hearing. 

At least Retired Judge Christopher Wilson allowed one of the alleged victims to read a statement in court on 5/1 and instructed Ms. Kathleen Bryson to file a written motion to withdraw as counsel on the second case. Retired Judge Joyce Hinrichs could have done all this several hearings ago instead of just continuing the hearing on motion to remand multiple times because she couldn't be bothered and the court backlog continues to grow year after year.

As I have said before, a male defendant or any other female defendant would have been remanded by now. She maybe behaving now with the possibility of being put in custody before her trial. What guarantee is there that this behavior will not repeat? It is clear from her obsessive and repeated behavior towards the alleged victims and a local attorney and anyone she feels is "persecuting" her that unless there are consequences like time in custody, she does not get she is the problem. If you didn't read my previous and initial coverage; you should. Not once has Analia expressed remorse or taken responsibility for her actions. Not that I would believe her. Apologies are meaningless if not accompanued by real remorse and actions. The biggest victim is the innocent child while the criminal and family law cases drag on the system and the impact felt for years to come.

 Let's see what happens on 5/9. At least Judge Wilson reads the files.

Dismissal? Settlement? In two cases involving Roy Gomez looks like Paul Hagen 2, Cyndy Day-Wilson 0

 

In January, I reported on two lawsuits. On 4/22/24, there was a case management conference in CV2301853 Rogelio Roy Gomez, Jr vs Alison Trout, Brian Trout, Does 1-10 and CV2201470 Tom Neuman vs Rogelio Gomez. The cases have been consolidated. Mr.Paul Hagen represents Neuman and the Trouts. Ms. Cyndy Day-Wilson is Gomez' attorney. 

According to 4/22 court minutes, Mr. Hagen told Judge Timothy Canning, Ms. Day-Wilson has dismissed their case and requests time to complete settlement. A dismissal hearing is scheduled for 6/14. When the case is finally resolved, maybe more details will be available.

I already reported in previous posts that both 995 motions filed by Brandon Widmark's attorney, Ms. Rebecca Linkous were denied. You can read the two page ruling by Judge Lawrence Killoran in one of the cases which is very succint. Judge Steven Steward heard the other 995 motion and he also denied the motion.

There were multiple hearings filed by Ms. Linkous on multiple issues and both 995 motions were heard on different days.

Fugitive from justice case for Ryan Doucet dismissed

 

On 5/1,  Ryan Doucet 2024 case for fugitive from justice was scheduled for confirmation of transport. Instead the case was dismissed without prejudice and Doucet was ordered released. On April 11, Doucet was sentenced to14 years in state prison in another case.

Fourth continuance for man charged with three sex offenses involving a minor

 

Fourth continuance for Dakota Stanley is charged with PC288.4(b) arranging a meeting with a minor to commit a lewd and lascivious act and PC 288.2(a)(2) sending harmful material to seduce a minor and PC 311.11 (a) possession of child pornography.

The preliminary hearing  scheduled 5/1 was continued to 5/21 after an oral motion by defense for a continuance for further discussions with the DA.

"Dear President Jackson: We write on behalf of the American Civil Liberties Union of Northern California and the First Amendment Coalition to express concern about Cal Poly Humboldt’s “hard closure”1 and restrictions to media access on campus.2 Our organizations work to protect the free speech and free press values enshrined in both federal and state law. We believe that the university’s policy limiting public access—and especially press access—is constitutionally suspect. We recognize that this closure has been asserted in response to the recent civil unrest and involvement of law enforcement at Cal Poly Humboldt,3 but it is precisely in these moments that reporting by a free press is essential. We urge you, in the strongest possible terms, to lift this campus-wide closure."

"Pursuant to both policy and practice, Cal Poly Humboldt maintains spaces on its campus that constitute a designated public forum.4 Any restriction on access or speech in these spaces must therefore satisfy constitutional review."

"Lastly, and in regards to reports that a member of the press was detained by law enforcement officers or otherwise prevented from newsgathering while on campus this week, we would like to take this opportunity to respectfully remind the university that the press, including student journalists, are not the enemy. They are people doing the brave, tireless, and sometimes messy work of reporting on public events. They should be afforded the university’s respect, and the public’s gratitude."
